1. About these Terms
These Terms of Use govern your use of Gradient: Study Tracker, including the app, website, account system, sync features, feedback tools, free plan, Lifetime Premium purchase, beta access, and related services.
By downloading, accessing, creating an account, or using Gradient, you agree to these Terms. If you do not agree, do not use Gradient.
These Terms operate alongside Apple’s Standard Licensed Application End User License Agreement, unless a separate custom licence is provided through the App Store. Apple’s standard EULA generally applies to apps distributed through the App Store where the developer has not provided a custom EULA.
2. Who can use Gradient
Gradient is intended for secondary-school and university students aged 13 and over.
You must not use Gradient if you are under 13.
If you are under 18, you should only use Gradient with permission from a parent or guardian where required by law.
You are responsible for making sure your use of Gradient is lawful in your country or region.
3. Accounts
Some features require a Gradient account. To create an account, you may need to provide an email address and password.
You are responsible for:
- providing accurate account information;
- keeping your password secure;
- not sharing your account with others;
- telling us if you believe your account has been accessed without permission.
We may refuse, suspend, or delete accounts where reasonably necessary to protect Gradient, other users, or the security of the service.
4. Educational and study-tracking purpose
Gradient is a study tracker and academic progress tool. It helps you record assessment results, study sessions, goals, trends, and related progress information.
Gradient is not a school, tutoring provider, assessment authority, medical service, psychological service, financial service, or professional advisory service.
Any insights, trends, suggestions, estimated GPA values, streaks, progress summaries, or period reviews are provided for general educational and motivational purposes only. They may be incomplete, inaccurate, or not suitable for your circumstances.
You should not rely on Gradient as your only source of academic advice. You remain responsible for your own study decisions, subject decisions, assessment preparation, and academic planning.
5. User data and content
You may enter information such as subjects, assessment names, results, grades, study sessions, satisfaction ratings, grading preferences, and related learning preferences.
You are responsible for the information you enter into Gradient.
You must not enter content that:
- belongs to someone else without permission;
- identifies another student without their permission;
- is unlawful, abusive, discriminatory, threatening, or harmful;
- includes health, medical, highly sensitive, or unnecessary personal information;
- infringes another person’s intellectual property rights;
- attempts to interfere with Gradient’s systems or security.
Your privacy is governed by the Gradient Privacy Policy.
6. Sync and cloud storage
Gradient may use Supabase to provide account services, feedback, and cloud sync.
If you use sync, your data may be uploaded to Supabase so that it can be backed up and restored across devices. Synced learning data is designed to be encrypted before upload, but account information, feedback, operational records, and some service data may not be end-to-end encrypted.
You are responsible for keeping your account credentials secure.
We do not guarantee that sync will be uninterrupted or error-free. You should keep your own records of important academic information outside Gradient where necessary.
7. Free plan
Gradient may offer a free plan with limited features. The free plan may include limits such as a maximum number of assessment results, limited widgets, limited sync, limited reports, limited focus tools, or other feature restrictions.
We may change the free plan from time to time, but we will try to avoid making unreasonable changes that remove access to your existing data.
If you exceed a free-plan limit, you may be prevented from adding more data or accessing certain Premium features, but we will aim to let you continue viewing your existing data unless there is a technical, legal, or security reason not to.
8. Lifetime Premium
Gradient may offer a one-time Lifetime Premium purchase through Apple In-App Purchase.
Lifetime Premium terms are explained in the separate Lifetime Premium Terms, which form part of these Terms.
All purchases are handled through Apple’s App Store and StoreKit systems. Apple processes payment and may handle refunds according to Apple’s policies. Apple’s support materials explain that App Store purchases may be eligible for refund requests through Apple.
Nothing in these Terms limits any non-excludable rights you may have under Australian Consumer Law or other applicable consumer protection laws. The ACCC explains that Australian consumers have consumer guarantees that cannot simply be removed by business terms.
9. Beta testing and free Premium grants
We may offer beta testing, TestFlight access, early access, or free Lifetime Premium grants to some users.
Unless we clearly state otherwise in writing, beta access does not guarantee free Lifetime Premium.
Free Lifetime Premium for beta testers may be awarded at our discretion based on meaningful participation, useful feedback, bug reports, testing activity, or other contribution to Gradient.
Beta builds may contain bugs, incomplete features, design issues, sync problems, data loss risks, or unfinished payment and Premium logic. You should not rely on a beta build as your only copy of important study data.
10. Feedback
You may submit feedback, bug reports, feature requests, or suggestions.
By submitting feedback, you give us permission to use it to improve Gradient, develop features, fix bugs, update designs, prioritise work, and communicate with you if you provided contact details.
You are not entitled to payment, credit, ownership, or compensation because we use an idea, suggestion, bug report, feature request, or other feedback you submitted.
Do not include sensitive personal information, health information, unnecessary academic details, or information about other people in feedback.
11. Focus Restrictions
Gradient may offer Focus Restrictions using Apple Screen Time, Family Controls, or related system frameworks.
You are responsible for choosing which apps or websites to restrict. Gradient does not guarantee that Focus Restrictions will block every distraction, work on every platform, prevent every workaround, or operate without interruption.
You must not use Focus Restrictions in a way that unlawfully controls another person’s device or restricts another person without permission.
12. Notifications
Gradient may provide local reminders for study sessions, streaks, progress, period reviews, assessment tracking, or app usage.
Notifications are optional and can be controlled through your device settings.
Gradient is not responsible if you miss a reminder, disable notifications, fail to receive a notification, or receive a notification at an inconvenient time.
13. Sharing and exports
Gradient may let you generate or share milestone graphics, period reviews, or other visual summaries.
You are responsible for deciding what to share and with whom. Once you share or export content outside Gradient, we cannot control how other people use, copy, store, or distribute it.
14. Acceptable use
You must not:
- reverse engineer, copy, resell, sublicense, or commercially exploit Gradient except as allowed by law;
- interfere with Gradient’s servers, APIs, analytics, sync, security, or payment systems;
- attempt to access another user’s account or data;
- use Gradient to store unlawful, harmful, abusive, or infringing content;
- bypass Premium restrictions, payment systems, account limits, or technical protections;
- use Gradient in a way that damages the app, service, developer, users, or third-party providers.
15. Intellectual property
Gradient, including its name, logo, design, interface, charts, code, visual style, copy, and features, is owned by us or licensed to us.
You receive a limited, personal, non-exclusive, non-transferable right to use Gradient in accordance with these Terms and the applicable App Store terms.
You retain ownership of the information you enter into Gradient, subject to the permissions needed for us to operate, sync, back up, display, analyse, and support the app.
16. Changes to Gradient
We may update, modify, remove, suspend, or discontinue features.
We may make changes for reasons including security, legal compliance, App Store requirements, technical limits, pricing, product direction, or service availability.
We will try to avoid changes that unfairly remove the core value of a paid purchase, but no app can be guaranteed to operate forever, on every device, or on every future operating system.
17. Availability and outages
Gradient may be unavailable from time to time due to maintenance, bugs, internet outages, Supabase issues, Apple issues, device issues, App Store changes, operating-system updates, or other reasons.
We do not guarantee uninterrupted access, error-free operation, or permanent compatibility with all devices or operating systems.
18. Account deletion and inactive accounts
You may request or initiate account deletion through Gradient where account features are provided.
If you delete your account, we will take reasonable steps to delete or de-identify account records and associated cloud data, except where we need to keep limited information for legal, security, accounting, dispute-resolution, fraud-prevention, or platform-compliance reasons.
Gradient may automatically delete inactive accounts and associated cloud sync records after 12 months of inactivity. Inactivity may include no sign-in, no sync, no upload, and no meaningful account activity for that period.
Deleting the app from your device does not necessarily delete your Gradient account or cloud data. Use the in-app deletion tools or contact us if you want cloud data deleted.
19. Termination
You may stop using Gradient at any time.
We may suspend or terminate access if you breach these Terms, misuse Gradient, create security risk, abuse support channels, attempt to bypass payment or account systems, or use Gradient unlawfully.
Where reasonable, we will try to avoid deleting your data without warning unless urgent action is needed for security, legal, or abuse-prevention reasons.
20. Disclaimers
To the extent permitted by law, Gradient is provided “as is” and “as available.”
We do not promise that Gradient will:
- improve your grades;
- predict your results accurately;
- replace school advice;
- prevent distraction;
- preserve data forever;
- operate without bugs;
- remain compatible with every future device or operating system;
- be available in every country or region.
Some laws, including Australian Consumer Law, may provide rights that cannot be excluded, restricted, or modified. Nothing in these Terms excludes those rights.
21. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or economic loss, including loss of data, loss of opportunity, academic disappointment, lost study time, device issues, or reliance on incorrect information.
Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law.
22. Third-party services
Gradient may rely on third-party services including Apple, Supabase, PostHog, and other providers described in the Privacy Policy.
We are not responsible for third-party outages, terms, privacy practices, account systems, refund processes, or platform rules, except where the law says otherwise.
23. Changes to these Terms
We may update these Terms from time to time.
If changes are material, we will take reasonable steps to notify users, such as through the app or website.
Your continued use of Gradient after updated Terms become effective means you accept the updated Terms.
24. Governing law
These Terms are governed by the laws of Victoria, Australia, unless the laws of your country or region require otherwise.
